Maryland Privacy Policy

Last Revised on: October 22, 2025

ACT Healthcare & Wellness Solutions (“ACT,” “we,” “us,” or “our”) provides this Privacy Policy for Maryland Residents (“Maryland Privacy Policy”) as a supplement to the information contained in ACT’s primary Privacy Policy. Any terms defined in the Maryland Online Data Privacy Act of 2024 (“MODPA”) have the same meaning when used in this Maryland Privacy Policy.

This Maryland Privacy Policy applies only to information collected through the following website: acthealthcarewellness.com  (“Website”) or that we collect offline. This Maryland Privacy Policy does not apply to information collected through third-party platforms or partner websites. Some information collected through our Website may be subject to ACT’s Notice of Privacy Practices under the Health Insurance Portability and Accountability Act (“HIPAA”), rather than this Policy.

For more information, please see our Notice of Privacy Practices.

Definitions Specific to This Policy

MODPA includes definitions for terms specific to this Maryland Privacy Policy that do not apply to ACT’s general privacy policies, including:

  • “Personal Data” means information that identifies, relates to, or could reasonably be linked to a specific individual or household. It excludes publicly available data, deidentified or aggregated data, and data covered under HIPAA or other federal laws.
  • “Sensitive Data” includes health information, biometric data, geolocation, racial or ethnic origin, religious beliefs, sexual orientation, and data concerning a minor.
  • “Sale” or “Sell” means the exchange of personal data for monetary or other valuable consideration.
  • “Share” or “Sharing” means transferring personal data to a third party for targeted advertising or profiling.
  • “Processor” means a vendor or contractor that processes personal data on behalf of ACT under a written agreement.
  • “Third Party” means any non-affiliated entity that is not a processor or vendor.

The Personal Data We Collect and Disclose

Over the past 12 months, ACT Healthcare & Wellness Solutions has collected and disclosed various categories of personal data to support our mission of delivering holistic, dignified care. This data is gathered through our website, client communications, intake forms, and service interactions. We use this information solely for business purposes that align with our care model, and we do not sell personal data for monetary gain.

We collect unique identifiers such as names, addresses, email addresses, phone numbers, and IP addresses. These are obtained through our website, email communications, and marketing platforms. This data allows us to respond to service requests, provide updates, deliver newsletters, and personalize care. We may disclose this information to our website providers, CRM vendors, and marketing partners, and share it with analytics platforms to improve user experience.

Health and medical information—including diagnoses, treatment notes, and insurance details—is collected directly from clients or their authorized caregivers. This sensitive data is used to coordinate care and wellness services and is disclosed only to licensed providers and billing partners. We do not sell or share this category of data.

Protected class data, such as age, sex, disability status, and veteran status, is collected through intake forms and service requests. This information helps us ensure accessibility and match clients with appropriate care providers. It is disclosed internally within our care team and is not sold.

We also collect internet activity data, including browsing history, device type, and interaction patterns. This data is gathered through our website and cookies to enhance site performance and user experience. It may be shared with analytics vendors and advertising platforms for targeted outreach.

Geolocation data is collected through mobile access and website interactions to help route appointments and determine service availability. This data is disclosed to our website providers but is not sold or shared for advertising.

Employment and education information is collected from job applicants and referrals to support hiring and staffing. This includes resumes, job history, degrees, and certifications. These details are disclosed to HR platforms and are not sold.

Inferences drawn from service history, preferences, and survey responses help us personalize care and improve offerings. These insights may be shared with CRM vendors and analytics providers to refine our services.

Sensitive personal data—including health status, race, religion, and sexual orientation—is collected only when voluntarily disclosed. It is used to support holistic and spiritual care and is handled with the utmost confidentiality. This data is never sold or shared.

ACT will not collect new categories of personal data or use existing data for unlisted purposes without providing prior notice. We remain committed to transparency, and Maryland residents have the right to access, correct, delete, or limit the use of their personal data at any time.

Your Rights Under MODPA

Maryland residents have the right to:

  • Confirm whether ACT is processing your personal data
  • Access and request a copy of your personal data
  • Correct inaccuracies in your data
  • Delete personal data (subject to legal retention)
  • Opt out of the sale or sharing of personal data
  • Limit the use of sensitive data
  • Appeal any denial of your request

You may submit a request up to twice in a 12-month period. We may be unable to fulfill requests that cannot be verified or conflict with legal obligations.

Authorized Agents

You may designate an authorized agent to submit privacy requests on your behalf. We may require verification of your identity and the agent’s authority.

Opting In After Opting Out

If you previously opted out of data sharing, you may opt back in at any time by contacting us at privacy@acthealthcarewellness.com.

Residents Under Age 18

ACT does not knowingly collect or sell personal data of minors under 18 without affirmative authorization from a parent or guardian.

Financial Incentives

ACT does not offer financial incentives in exchange for personal data.

Additional Maryland Privacy Rights

Maryland residents may file complaints with the Maryland Attorney General’s Office. ACT will not discriminate against you for exercising your privacy rights.

Changes to Our Maryland Privacy Policy
